The felony charges filed against, Heath Christopher Britt, 41 of 109 S. Newton Street in Elizabethtown, NC were dismissed, according to court documents. Lack of evidence and no prior felony convictions against Britt were the reasons for the dismissals, according to his attorney. Britt did plead guilty to one misdemeanor charge.

However, according to Adam Whitaker, Assistant District Attorney handling the case, the plea was taken not because there was lack of evidence to move forward with the case, but because of Britt’s record and the facts of evidence in the case. Whitaker explained allowing Britt to take a plea to the misdemeanor charge will allow the DA to seek stiffer sentencing if Britt is found guilty of drug charges in the future.

Britt’s attorney, Wes Johnson stated, “It’s not fair people get judged on the mere mechanism of them being charged.”

Britt was placed in the Bladen County Detention Center in mid-January, 2020 for failure to appear on drug charges. At that time, Britt was held under a $50,000 cash secured bond.  Later, the court lifted the secured bond and reduced the bond to an unsecured total of $17,600, at which time Britt was released from the county jail.

According to court documents, Britt’s charges were heard in Bladen County District Court on Friday, February 14, 2020 with the Honorable Judge Scott Ussery presiding over the case.

Britt was charged with one (1) felony count of Possession of Cocaine, Possession of drug paraphernalia, and it was dismissed without leave by the District Attorney’s Office, one (1) felony count of Possession of Cocaine, which was dismissed without leave by the DA’s office, and one (1) felony count of Maintaining a vehicle to distribute cocaine, Possession of controlled substance near a school, which was also dismissed without leave by the DA’s office. On the (1) Misdemeanor charge, Possession of Drug Paraphernalia, Britt pled guilty.

Legal Definition of Dismissal without leave means that there is no permission to amend or refile a complaint, it is dismissed completely.
