courtThe trial of Marquail Dashawn McKoy was delayed Monday when investigators say new evidence was found and the Elizabethtown teenager, for the third time, rejected a plea offer from the state for discharging a weapon into occupied property.

Instead, McKoy, who is 17, told Superior Court Judge Ola M. Lewis that he wanted a jury trial on charges of attempted first degree murder and discharging a weapon into occupied property from a shooting incident last March.

Under the state’s plea offer rejected Monday, McKoy would have received between 60 and 84 months in prison. Lewis told McKoy that, if found guilty of the two charges, he could face up to 24 years in prison.

However, before jury selection could begin Monday, Bladen County Assistant District Attorney Glenn Emery told the court that new evidence had been found that may lead to additional charges against McKoy. McKoy is likely to be charged with assault with a deadly weapon with intent to kill, and may face charges of witness tampering and obstruction of justice, depending on the outcome of the investigation, according to court statements.

Investigators say McKoy sent a note about the case in a sock to his house among items he wanted washed.

McKoy was arrested March 4 after Elizabethtown police officers were called to the 400 block of Kemp Street in response to shots being fired about 4:55 p.m. Investigators say that McKoy and another person had argued inside a residence. McKoy then left the residence and the second person followed a short time later.

McKoy shot at the man as he came out of the residence before fleeing the scene, according to the investigation. No one was struck by the shot, but officers found a bullet hole in the man’s shirt, and the bullet went inside the residence, investigators say. McKoy was arrested about four hours later.
