A murder case against Harold Eugene Swindell was declared noncapital this week and his bail was set at $500,000 secured by Bladen County Superior Court Resident Judge Douglas Sasser.

The declaration of noncapital means Swindell will not be facing the death penalty in the matter. He could still face a sentence of up to life without parole.

Swindell is charged with first degree murder in the May shooting death of Lonnie Level Smith of Jasmine Lane, Clarkton. The shooting ocurred at Oakdale Homes in Clarkton following an altercation in the parking lot. Swindell turned himself in to authorities.
