A jury failed to reach a verdict Friday in the trial of retired Trooper Herbert Weissinger of Elizabethtown on assault charges in a trial that lasted 2 weeks in Bladen County Superior Court..
Weissinger was charged with shooting two Cumberland County hunters off US 701 near Beard’s Chapel Loop Road north of White Lake on Christmas eve 2012.  He was facing two counts of assault with a deadly weapon inflicting serious injury following an investigation by the SBI.
Thomas David Daughety, Sr. of Parkton and his son, Thomas David Daughety, Jr of Fayetteville were treated for serious injuries.
The jury was reportedly deadlocked 11-1 in favor of a guilty verdict against Weissinger.  Assistant Glenn E. Emery said the charges would not be dismissed.  A new trial date has not been set but may be discussed in the March session of Bladen County Superior Court.
