The man charged in the shooting death of Lonnie Level Smith of Clarkton made his first appearance in court Monday before Judge William Fairley.

Harold Eugene Swindell, 47, of Clarkton, is charged with first degree murder and felony possession of a firearm by a convicted felon. He is currently being held without bond. If convicted of first degree murder, Swindell could be facing the death penalty. No bond was set.

Judge Fairley told Mr. Swindell he will be submitting his application for an attorney to the Indigent Defenders’ Office in Durham. The Indigent Defenders’ Office will appoint an attorney to represent Swindell. A probable cause hearing is scheduled for June 13.

Swindell is accused of shooting Lonnie Level Smith to death last week at Oakdale Homes in Clarkton. The shooting occurred following an altercation in the Oakdale Homes parking lot on Wednesday, May 17, at 6 p.m. Swindell turned himself in to authorities on Saturday morning.
