Murphy-Brown has lost five trials in the hog nuisance lawsuits in North Carolina. In the five cases plaintiffs have awarded over $549,000,000 in damages, which includes punitive and compensatory amounts.

While the attorneys for the company file appeals and wait, the company is now having a legal battle with their insurance companies.

The insurance companies, though, have refused to pay Murphy-Brown’s claims. They argue in part that the policies don’t cover damages related to hog waste because of a “pollution exclusion clause.” Murphy-Brown is now suing the companies and accusing them of breach of contract.

The insurance case is being heard in North Carolina’s Business Court.
